The framework this industry asked for: regulation instead of elimination. Introduced July 22, 2026 by Rep. Andy Barr (R-KY) and Rep. Angie Craig (D-MN) — now backed by eight lawmakers, four Republicans and four Democrats. Referred to Ways and Means, Energy and Commerce, Agriculture, and Transportation and Infrastructure. The next fight: a committee hearing before December. Status as of September 9, 2026.

A two-year delay of Section 781
If the framework cannot pass before the deadline, Congress should delay the redefinition to write rules properly — not let a de facto ban take effect by default.

The hemp redefinition — effective Dec 11th, 2026
Redefines legal hemp by total THC — including THCA — and caps finished products at 0.4 mg total THC per container. Congress delayed most of Section 781 to December 11, 2026 (H.R. 6500, signed September 2). The exception: cannabinoids the cannabis plant cannot naturally produce lost federal hemp status on November 12, 2026.
